The Department of Education in Georgia will investigate the role of a Transgender Bathroom policy after a five-year-old girl was assaulted at school. The complaint, filed by the parents of the victim, states that she was sexually assaulted in the bathroom at school. The Department of Education is investigating whether or not the transgender policy created a “hostile environment.”
The complaint has the ability to upend the national debate pertaining to the transgender bathroom policy. Further, both sides of the argument are claiming that the policy is discriminating to their respective parties.
In this case, the complaint was filed by the Alliance Defending Freedom on behalf of a parent at Oakhurst Elementary School in Decatur, Georgia. The complainant is stating that last November the transgender boy pushed her daughter against a wall “and forcibly touched her genitals despite her protests, causing her both pain and fear.”
After the report, the Education Department confirmed in an e-mail that the department is investigating the complaint.
“The investigation focuses on the school’s response to a report of sexual assault and the examination of any and all factors that may have contributed to a hostile environment,” Bailey said.
The Decatur school district said in a statement that “it is committed to supporting all students.”
“We are aware of the unfounded allegations made by the Alliance Defending Freedom,” the district said. “We fully disagree with their characterization of the situation and are addressing it with the Office of Civil Rights.”
