Another leak in a major abortion case at the U.S. Supreme Court has revealed that the high court will temporarily allow abortions in Idaho when a woman’s health is at risk.
This is one of the most eagerly anticipated opinions of this term, and it was published online briefly today before being removed. A court spokeswoman said the post was a mistake and the opinion will officially be issued soon.
Bloomberg News reports the opinion showed a majority of the court agreed to dismiss the case involving Idaho’s abortion ban and to reinstate a lower court ruling that undermines Idaho’s law.Â
But Justice Ketanji Brown Jackson reportedly wrote that the court’s decision will leave the issues at the heart of the case unresolved.
What the Case Is Really About
The Biden administration had sued Idaho claiming the state’s law violates a federal law called the Emergency Medical Treatment and Labor Act (EMTALA). The White House insists the EMTALA requires hospital emergency rooms to provide abortions to women if their general health is at risk. Idaho’s law already provided an exception to save the life of the mother, so the case is seen as an effort to expand abortion access beyond that.
